Why did Biden administration ask Supreme Court not to hear challenge to all-male military draft?

Today, guest host Todd Herman said that the reason the Biden administration asked the Supreme Court not to hear the ACLU challenge to an all-male military draft was because the Democrat Congress is ready to issue legislation to allow the drafting of women for military service.
Therefore, if the Supreme Court hears the case, then decides that an all-male military draft is constitutional, the ability of the legislature to create a law that is different would be nearly impossible. Much better for the Democrats to stop the hearing, and go forward with the legislative agenda they have on the subject.
